These Terms of Service ("Terms") govern your access to and use of the services provided by Solid Ground Calls Business Process Outsourcing Services ("SGCS", "we", "us", or "our"), operating as Solid Grounds Calls Services. By engaging our services or submitting a contact inquiry, you agree to be bound by these Terms.
1. About Our Services
SGCS provides 24/7 after-hours emergency call handling and dispatch services for water damage restoration companies operating in the United States and Canada. Our services include:
- Live answering of inbound emergency calls on behalf of client companies
- Call qualification and intake using client-approved scripts
- Immediate dispatch notifications to client crews
- Call logging and reporting
2. Client Responsibilities
Clients engaging SGCS services agree to:
- Provide accurate and up-to-date contact information for dispatch
- Supply approved call scripts and intake procedures prior to service commencement
- Maintain a responsive crew for dispatched calls during agreed service hours
- Notify SGCS in advance of any changes to dispatch contacts, service areas, or operating procedures
- Use SGCS services only for lawful business purposes
3. Service Availability
SGCS aims to provide uninterrupted 24/7 service coverage. However, we do not guarantee continuous, uninterrupted availability and shall not be liable for service interruptions caused by factors outside our reasonable control, including but not limited to telecommunications outages, internet disruptions, or force majeure events.
4. Confidentiality
SGCS treats all client business information, call data, and customer details shared in the course of service delivery as strictly confidential. We will not disclose client or caller information to third parties except as required by applicable law.
5. Fees and Payment
Service fees are agreed upon between SGCS and the client prior to commencement of services. Payment terms are outlined in individual service agreements. SGCS reserves the right to suspend services for non-payment after reasonable notice.
6. Pilot Program
SGCS may offer a free 30-day pilot program to select clients. The pilot is provided at no cost and with no obligation to continue after the pilot period. SGCS reserves the right to limit pilot availability and eligibility at its sole discretion.
7. Limitation of Liability
To the maximum extent permitted by applicable law, SGCS shall not be liable for:
- Any indirect, incidental, or consequential damages arising from use or inability to use our services
- Lost business, lost revenue, or missed jobs resulting from call handling errors or service interruptions
- Actions taken by client crews based on dispatched call information
Our total liability in connection with any claim arising from these Terms shall not exceed the fees paid by the client to SGCS in the one (1) month preceding the claim.
8. Termination
Either party may terminate the service engagement with written notice as specified in the individual service agreement. SGCS reserves the right to terminate services immediately for violation of these Terms or for conduct that poses a risk to our operations, staff, or other clients.
9. Intellectual Property
All content on solidgroundscallservices.org, including text, graphics, logos, and design, is the property of SGCS and may not be reproduced without prior written permission.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these Terms or from service engagements shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to the appropriate courts or arbitration bodies in the Philippines.
SGCS is registered with the Department of Trade and Industry (DTI) of the Republic of the Philippines as a sole proprietorship, registration number 7770358, at #95 General Menez Street, Parang, Marikina City, Philippines.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of our services after any changes constitutes acceptance of the updated Terms.
